    Hi all,


    When started working for Company A it used to operated from 2 diffrent locations Newjersy ,New hampshire (Excutive office).
    My Company applied Labor from NH in March 2005 (before perm).6 months back my case was moved to New York regional center ( i am not sure why it is moved to NY insted of newark NJ).
    Recently they closed (in April 2010) the NH Branch .

    What will happen to my green card ..? (labor is applied for NH location)

    When i check with my employer he is saying NH location is Executive office it will not have any impact .
    if reuqired he is ready open office in NH with new address

    What should i Do...? i am totally in confusion state .. and now my dates current from july ,2010.

    We need to make a very important decision this weekend and any help will be highly appreciated.

    My husband�s (EB3/India) employer is willing to give us a �Labor Substitution/I-140� (PD: March 2005). But, I really want to apply for COS H4 to F1.

    So the two options we have is
    1) Apply for both �Labor Substitution/I-140� and COS H4-F1
    2) Apply for COS H4-F1 and let go of �LC Sub�.

    I have spoken to a lawyer and he is saying that we can apply for both �LC Sub� and COS and that there is a very good chance that COS will also go through, although there is a very small risk. But, I am getting conflicting messages from other sources suggesting there is a high risk of COS being denied.

    We are trying to determine the amount of risk we are taking if we apply for "LC Sub" and COS at the same time. If the risk is high, that we would just apply for COS H4-F1.

    This is a really tough decision and any advice would be greatly appreciated.

    Hi,

    I am transfering my H1b to my friends company. And I have to bear all fees. As such my case is simple, no complications. I have good education credentials and 10+ years of exp. Got education evaluation also with me.

    I just went thru USCIS site and it looks like to me that filing H1 transfer by myself (or by my friend) is a fair simple job.

    Can anybody give me advice or have some experiece in filing H1 or transfer H1?

    I would like to have a list of documents/forms needed to file for derivative I-485 for spouse.

    I did come across a few lists on the web, some overlap and some don't, but they do not necessarily address the full list of documents needed when Primary's I-485 is already pending and spouse is filing separately at a later time.

    The derivative beneficiary is already in US on a dependent Visa, looking to do AOS instead of CP.

    I would appreciate if anyone can provide a list and it'll be great if any members in a similar situation have done it themselves.

    Here is my situation, I will file for I-485 on July 1st.....but on July 21 I have to leave U.S....and my question is:

    Can you leave the country as soon as you filed for I-485? or you have to wait for I-485 reciept?...I know it's mandatory to stay in U.S at the time of filing for I-485.....And is it true that after you file for I-485 you can leave U.S without any problems?

    Please advise me.

    Hi all,

    I got my labour approved in Jun'07 and applied for my I-140 in Aug'07 and have been waiting for it to be approved since then. I have not yet applied for I-485. Also,I am almost reaching my 6th year of H1-B visa(FYI:I have not got my visa stamped yet).

    Now my questions are,

    1) Will I be able to switch my employer now that I am in my 6th yr of H1-B.
    2) If it's OK to switch, how many months are supposed to be left on H1-B visa to transfer to another employer.
    3) What will happen if my present employer revokes my GC application.
    4) When is the best time to switch as I will get 3 yrs of extension once I-140 is approved.
    5) Will I be able to retain my priority date if my employer revokes my GC application.

    Please do respond. I look forward to your replies.

    Hi,
    My L1B visa & petition with Company A runs upto Sep this year.
    I'm applying for H1B petition with company B this year.
    my current Company A will try to go for L1B petition extension, so that I can continue being here beyond september.

    My concern is if these 2 will clash with each other ?

    One of my friends said that whichever petition gets approved latest - will be the one that holds good.

    So if L1B extension gets approved after h1B, will that negate H1B ?
    and vice-versa ..

    Currently I�m holding h1 and same time has AOS with my existing employer. I�m continuing my employment based on h1 and use Advance parole for travel purpose. My employer mentioned about not revoking I-140, even if I move to new employer. Since with new client, I�m transferring my H1 visa, I have 2 options with regard to my AOS portability

    1) Either just transfers my h1 without porting AOS with new client. Continue with my AOS with old employer, since he won�t revoke my I-140 and provide support for future employment.

    2) H1 transfer and Porting my AOS with new client and it does require my job and description mentioned in I-140 matches with current offer.

    I would really appreciate, if you provide your valuable suggestion/recommendation. The best option to go ahead with.

    Hi there,
    I work for one of big 4 consulting companies. Home office based NJ and live in NJ as well. Travel to Client A mon - thurs.

    I rolled off from the project at client A and will be starting at client B.
    Both Client A & B are in the same city in MA.

    1. Will a LCA update be required even if you new client is in the same city/ state ?

    2. How long does it take these days to update the LCA ?

    3. Like H1 transfer can you start working at the new client on the USCIS receipt # ?

    Hi,

    My employer filed H1B transfer in Feb 2009. however he could not receive RFE letter with in time on mail and only received after RFE submitted date was expired which is May 25th, 2009

    In jun1 1st week , he filed for the RFE extension for the stated reason and also refiled H1B to make sure that I should be in valid H1B status in case of first H1B denial in mean time

    Employer submitted all the documents related to RFE on June 20th and it got approved on jul 1st.

    What are the best options for H1B refiling case

    in case if it is denied, will it super impose the original H1B approval ?

    is it good idea to cancel/revoke pending H1B refiling case ?

    Hello all,

    I applied for I485 + I150 in June 2007 under EB3. My I-140 is still pending.

    Employer used a preappr labor with PD of May 2005. However, the lawyer gave me only the ETA 750B portion of the labor to fill

    Now, from some forum I found out that PERM was started in March 2005 and the form was 9089 to be used for labor after march 2005 filings.

    So, how did my employer file my labor using ETA750B part which was applicable for old labors since my PD is May 2005 which is after the PERM?

    Lawyer and Employer are not willing to help, hence reaching out.

    I would apply for the renewal EAD now. Are you using the EAD to work ? Normally if the EAD is not approved after 90 day wait, then one can get a temp EAD form the local office. Give yourself some time, just in case something gets dealyed.

    Mine and my wife's 485 must have been "touched" today ... not sure why though. The status still says "Case received and pending..."

    Any ideas fellow members? Could it be good sign or just standard update...?
