You must submit the 485 through a lawyer if your priority is current, check the visa bulletin. You can always file when 140 is approved and you are still employed with same employer. You can also file EAD & AP for work permit and international travel. Get a lawyer asap.

Hi,

I am from India.I am on H4(dependent visa),with a stamped expiry date of May 7,2010 on my H4 visa and I-94.I got a J1 offer for further studies in USA.Till I get my required documents for J1 visa,I am guessing it will be beyond this date.My husband has already applied for his visa extension.

1.Now,if I plan to get stamping of J1 in Mexico after the H4 expiry date but with necessary receipts and documents (for H4 related),will I face any problems?
2.Do I need to go to India(my home country) for sure for stamping?
3.Is it better to have status change in USA itself(will delay start of the course)?

Awaiting for feedbacks.

Switched jobs in April 07. My attorney tells me that my Labor can be filed only in mid July at the earliest.

1. How long does it take for Labor to be approved? I am guessing end of September is when retrogression will kick in. Do I have enough time for that?
2. How long does it take to get the documents ready for to file I-140 and I-485 (counting eggs before it's hatched)? If I have Birth and Marriage certificates ready, is there anything else that I should watch out for?

BTW, don't think I am trying to take a short cut to independence. I did my time in backlog for 3 years, got fed up and quit.

Hi,

I am filling out an LCA online for an employer who is hiring someone as an H-1B transfer. I am using iCERT and had a question as I go through the process:

Part E. Attorney of Agent Information
16. Law firm/Business FEIN:

This sections asks me for my law firm tax ID number. However, I am a solo practitioner so do not have a TIN or EIN - I use my SSN for taxes etc.

If I leave this part blank, or put N/A will this make them deny my LCA? I called their help desk, but am waiting (who knows how long) for them to respond.

I am on 6th year and need to extend my h1b. My lawyer informs me that 45day letter from Backlog center is enough for 7th year extension.

I thought we need to get the screen-shot of pending labor as a proof for 7th year extension.

Does anyone got extension based on 45day letter for the 7th year or beyond....???

Just found this extension a few seconds ago for those (including me) who haven't mastered gradients or partially alpha'd parts of an image, and who are too cheap to buy Photoshop and instead use Paint.net

Friends,

I came to USA on H1B on Feb-07. I was working all the time except 6 months. I have pay slips with me and W2 forms. Now I am working on the project but it will be over on 15th of April-09.

I will complete my 3 years. But after this project is over, I don't know I can find the job again.

My question is,is it right time to do the visa transfer? Does it requires very recent pay stub of 3 months? I do not have pay stub for Jan and Feb-09.Does it matters?

What will be my best choice to transfer the visa(but don't know will have job after 15th so does it matters for transfer like client letter) or wait until May-June and file the 3 year extension ? But again that time I will have pay slips until April only.

I am really confused. Please give me your suggestions

I need a clarification on EAD card usage. If your spouse whio has an independent H1B visa and whose 485 and EAD application is dependent on you, changes the work status from H1B to EAD, then does the status of the primary applicant also change to EAD automatically. Since the spouse's application was not independent filed and was a dependent on the original applicant for both 485 and EAD applications. I want make sure that the primary applicant's status ( separate independent H1B ) is not changed from H1B to EAD, just because of the spouse starting to use the EAD ( who is a dependent filer on primary applicant for both AOS and EAD ). Would appreciate your inputs.

Hi All,

How important is the location of the US embassy for getting the H1B visa stamping ? When applying for my H1B petition in April 2008, my lawyer had mentioned that I would be going to the US embassy in Germany for the H1B visa interview. I'm also aware that I could go to my home country for doing the same. However, does anyone know if I can go to Canada/Mexico, given that I have the visas to go to these countries ? I have a US H4 visa.
