If we were able to get the 3 year visa rather than 1 year extensions, then the main problem that the BEC give us in a practical sense is that if we change jobs we loss our priority dates.
So while the slow processing is an administration issue, the law could allow for priority dates to be kept something like this:
"If a labor application has been pending for longer than [some time] then as of [some date], the applicant immigrant is able to keep the priority date of the original labor application whether or not the application is later withdrawn or disapproved."
This in combination with 3 year extensions would give people freedom to either refile for PERM with same employer or move jobs and file for PERM with a new employer.

hello folks..
I was on H1.. but i quit my job and i am currently enrolled as a Full time student.
I need to go to Mexico as part of my Study program....
I have received the change of status from USCIS..but i need to get my passport stamped..
I have not been successful in getting an appointment in Canada....
>>is there a wait time in any canadian consulates...for more than 2-3 days????

i am not sure you can get an F1 stamp in either Mexico or Canada. You can only get an F1 stamp in these countries if you already have an F1 stamp, but it expired and you did not hold any other non-immigrant status in the interim.

Thought folks might find the following interesting.
I recently returned from a visit to Canada where I stayed with my brother-in-law, who owns a small but very successful web development shop. He told me that due to the booming Canadian economy, he can no longer find experienced programmers at reasonable bill rates. So he's been doing some outsourcing to get cheap foreign labor ... hiring American programmers !
Where was that? Vancouver? Toronto?
Was it Java or LAMP or .NET stuff?

Why should USCIS send two notices? To answer your question..NO..they will send you one date and location for FP! Also you have to do your FP every 15 months or so..if your case isnt approved by then!

All,
I am currently unemployed and my spouse needs to travel to Mumbai urgently. Our AP is valid through November 30, 2009. Will there be any issues for my wife when she comes back - possibly because of my current status. Wife is employed (with a different company)& the EAD/AP was filed by my last employer. My wife is currently working on H1B, she was offer permanent position at the client she is working, she has to get on to EAD to take permanent position.
both my wife and myself got EAD's in Oct 07, my question is does she has to invoke AC21 to get on to EAD.
I am the primary candidate for our GC Process.

Did you write to the Ombudsman in form 7001 about 140 delay ( other thread ). I sent it yesterday. When did you file 140 at NSC ?

I had enquired about 140 and got the same message. Then took an infopass and there the IO told there is nothing at 140 level and what I got is a standard reply .

Actually, you can file 485 when your PD becomes current, even if the 140 is still pending approval. You need to submit the 140 details alongwith your 484 application.
Once a I140 is filed without the I485 one has to wait for I140 approval before being eigible for filing I485

I'm trying to schedule an appointment for non-immigrant visa in August/September timeframe from last one week without any success. After filling the forms, and continuing further for checking the available dates, I get a message saying : " Interview appointments not currently available, please check back in 24 hours. "

As Fromnaija correctly explained, if you are an applicant for AOS with an approved EAD you are authorized to remain legally in the US as long as your application is pending. You Whether or not you are working does not matter.

Get a "good" lawyer. Someone who knows which tax documents to submit, where you and your wife needs to sign and someone who checks your forms before sending them to USCIS.
