But both of my labor certifcates are from the same company. I read somewhere I-140 is for intending to employ me. How can they employ me in two categories one on EB3 and one on EB2.

Hello,
Here's my situation. I have an approved I-140 (EB2), my I-485 has been pending for more than an year. Due to recent lay-offs, I will have to change my employer through an H-1B transfer. My wife was on H-4. However, just this year she got an H-1B approval with consular processing since when we applied for her H-1b this year, she was not in US.
Now 2 weeks back, her employer applied for her COS through regular processing. I assume this takes about 3-4 months.
My question is - now that I am doing my H-1B transfer to another employer, do I have to worry about my wife's H-4 extension as well, or just leave that as it is, as her application for COS to H-1B is pending with USCIS.
Please advise.

In my opinion, leave it as it is.
also, please spend few minutes to send out 4 letters in support of fight against cases using AC21 and getting denials without any reasons. You might very well fall in this if you plan/have to use your EAD.

I want to transfer from H1B to F1.I came to US as a F1 and graduated in march 08.I got my H1B on oct 08.But now i want to transfer to F1 again and i had my visa till 2011. I had following doubts and please help me.
1) I heard that i can transfer to F1 from H1B without canceling(but deactivating H1B) is it true.
2) How much time does it take if i apply for change of status for F1?
3)can i take cpt in F1 and later on can i change to H1 by applying change of status?

I think folks who applied in July are still waiting for AP approval. A few are still waiting for receipt notices. I would be surprised if August filers have received APs.

I had a opt which expired on the 9th. of november and on june 08 i applied to start green card process with help of a lawyer.I have a master degrees from the US and my lawyer told me that i did not need to apply for a H1 visa or a work permit and could directly go for green card. we started the process in june 08 and I applied to eta 9089 on september 08 and could not get any reply back for almost 5 months. My lawyer tells me that it is normal to not get an answer for so long even thought I think we had to get an answer in 3 to 4 weeks after september. Now, my lawyer suggests me to go back to my country as my status will be put of satatus and I could continue my green card process from back home.
I would like to know if my lawyer is telling me the truth or my lawyer made any mistake..

It makes no difference whether you file premium or regular H1. It goes thru same amount of scrutiny. Only difference is that you get it in 15 days with extra $1000 instead of 3 months it normally takes today.

Hi,
I am Planning to go TORONTO for my 2 H1B visa stamping.In my first experience my application was under administrative processing for 6 months, but since I have AP and EAD I came back,then when they called my Passport was about to expire in 5 Months so with my new passport it went into administrative processing for 2 more weeks then I was asked to come down to toronto and I got my H1-B
Now here are my concerns specially how to prove
1) Employer employee scenario( what docs will prove VO, I work as a IT consultant at third party have my H1B approved till 2013, visa is expired,Vendor is ready to give letter , client does not have this policy )
2) My project end date is feb 2011, what if he asks me what will i do after that, how to convince?
3) will my previous administrative processing triigers for admin processing again ? I heard that once you went to admin processing after that any time you go for stamping you will go through admin processing?
4) Will use of Advanc parole (in case of admin processing) TO come to US in anyway cause issues when admin processing is done and visa is to be issued?

A friend's H1B transfer from company A to company B was denied. Since his H1B with company A is still valid and is going to expire in 3 months, he can still go back to work for company A. However, if he chooses not to work for company A and tries to find a third employer to do another transfer, is he considered out of status for these three months?

I have sent the request for renewal of my and my wife's advance parole to the USCIS about 10 days back.
Following is the list of documents that I have sent, along with a fees of $360, online (each)
- Copy of the Confirmation Receipt notice.
- Copy of I-485 petition.
- Current Status of I-485: Case received and pending.
- Copy of I-94.
- Copy of current approved I-512L, authorization for Parole of an Alien Into the United States.
- Copy of Passport.
- Two photographs.
- Copy of Drivers License.
Do I need to send any fingerprinting document?
Is there anything else that I need to take care of related to this request for advance parole renewal?

How long is it taking now a days to get AP approval. I am from TX and e-filed on 2nd Oct (ND 4th OCT 2010) and want to know when I can expect the approval.

Take an infopass appointment, ask them to generate a finger print notice for the same day, then go to the office with your son, where they take the fingerprints. Keep calling USCIS and then a week later take the Infopass appnt again. That should do it.

I like the DOF, and it would also work if the whole string of flowers were sharp.
There is possibly a bit too much flash, the shadows between the flowers are a bit hard IMHO.

Today, our AP status has changed to "Document mailed to applicant". Does this mean that they have mailed the approval document or is it an RFE document?
For most of the applicants the status has turned to "Approval Notice sent" but mine is different. Is anyone in the same boat.

I was not sure if the consular districts are determined based on the state of current residence or based on the state of my permanent address in India or state that issued my passport. After reading your reply, I looked up what the embassy "loosely" defines consular district as at :
http://newdelhi.usembassy.gov/nivconsdist.html
So it does state that US residents can apply for the NIV at any of the four consulates. So does this mean that their emergency appointment requirement of being from the New Delhi consular districts applies only to residents of India and not residents in the US ? This seems subject to interpretation.

In order to be eligible for EB-2 classification you must have the equivalent of a US Master's Degree AND a US Master's Degree or its equivalent must be the minimum requirement for the position that is the subject of the I-140 Immigrant Visa Petition.
In other words, even if your education equates to a US Master's degree, you will not qualify for EB2 classification unless the empolyer can show that the job duties of the position could not be successfully performed by anyone not possessing at least a Master's degree or its equivalent.
