No, it does not include the spouse's application. The fee schedule will give you a good idea of what the fees are for each category.

Hi,
My wife's AP is expiring in mid of October 2010. I am going to apply for her new AP before she travels to India in the 3rd week of July. Is there any issue if she comes back with the new AP? As the renewed AP will be received while she is in India. She will leave with her existing AP and enter back (lets say in Nov 2010) with newly renewed AP.
Please guide.

I enter US four times this year by using AP, same airport, but different experience. 1st, 2nd and 3rd entry was sent to secondary check. But the 4th entry, the CBP said it's unnecessary for secondary check and fill new I-94 because previous officers are new guys, don't know the rule. I thought 1st entry is definitely need go secondary check.

Hi,
I am planning to visit India next month. I will transit thru Dubai in Emirates Airlines from West Coast. My 485 is pending and have valid AP and EAD. I have expired H1B visa stamp in my passport.
Did anyone use AP in this route?. Will I have any issues with Emirates Airlines and during transit in Dubai using Advane Parole?.
Please someone help me.

You can not do H-1 transfer any more. Your next H-1 petition will be a new petition but you will not be subject to H-1 cap as you already have been counted for 6 years.
So I presume it would safe to get a job offer and leave as soon as possible, then wait for the H-1 petition get approved, stamp H-1 visa and get back.

I think you are perfectly fine even if you don't apply EAD/AP with I-485. The only caveat, to my knowledge is that you have to wait for I-485 receipt. (correct me if I'm wrong). But based on the number of filings expected, nobody knows when you will get a receipt. Also, I think the I-485s, though filed will still be processed by priority date. The EAD/AP applications will be FIFO. So the more you delay filing them, the more time it will take for USCIS to process your EAD/AP, especially considering the number of filings expected. Based on the processing time for the I-765, which is now more than 90 days and the fact that interim EADs are not issued anymore (see below from USCIS), it is going to interesting to see how USCIS handles this.
Elimination of Interim EADs in Process (sometime in June 2006)
Under current regulations and procedures, persons who apply for EADs can go to the local USCIS offices and obtain interim EADs if the original filing takes 90 days or more. This convenience is likely to be eliminated in the near future due to USCIS concerns over the potential fraudulent use of the interim EADs. The USCIS's view is that the manufacture of EADs should occur at the Service Center level, and the expectation placed on the Service Centers is that they will process the EAD applications and manufacture the EADs within the 90-day processing period.
The USCIS acknowledged that there is a regulation in place providing for interim EADs, but note that this regulation may have to change. It seems that the antiquated machines for producing the interim EADs are going to be scrapped, eliminating the possibility of processing interim EADs at local offices, with or without the required regulatory change.

Has anyone been able to call USCIS premium processing toll free number today and talk to an Officer. I have been unable to get to an Officer today but was able to talk before. I am wondering whether there is a limit on how many times you can call(I have called 3 times so far in 10 days) or if you can't call after so many days have passed after your application is approved.

I have just gone thru March recording of IV lawyer call and the below caught my attention. Ms Susan mentioned that any company name change after I140 approval has to refile I 140. I am utterly confused as that particular scenario affect me and i would like to know what best course of action i can take at this point.
I filed LC and I 140 with company A
My I 140 got approved
Before i filed my I 485 my company changed its name
I asked my attorney at that time if we need to take any special action
Attorney said they can just add an amendment while applying for I 485 about name change and apply with approved I 140, which is with old company name.
I and my wife work on EAD for past 3 years and i am still employed with same company. I wonder which one of above attorney is correct and what i should do.
Does the fact that my I485 is pending for more than 180 days after approval of my I 140 will come to rescue in case of question about company name change (AC21)

3. Not necessarily. At any time, whenever you file extension, the criteria is checked again. Means if the 140 is revoked after getting 3 year extension, then the next H1 filing will get rejected, since you don't have a pending 140 anymore. So the answer is, it depends on whether you have a pending/valid LC/140 at that time.
My 6 years on H1b expires on Nov 2010. I have 140 approved from company A.

While i did apply for my green card i never applied for the EAD since i thought my job was realtively safe. Now if i do get laid off since i am still on H1B what consequences does this have and can i switch to EAD without being illegal?
secondly i was raped a while back while on a trip for work in the us. I still suffer from PTST and other things because of this, is there any help withregard to my legal status?
I know there is some humanitarian things at uscis would those apply to me and can i make use of those?
