No... as long as you can show ties to the US (owning a house, paid taxes, etc) you should be OK. In a situation where a company has sent you overseas, if you have adequate documentation to prove that the company had sent you overseas and you are still on the payroll here, you should be OK. Although, to be safe, I would probably try to make a couple of trips back to the US in a year to maintain resident status.

Hi,
I am planning to file EB2 and port my EB3-I140 PD. My current position is System Analyst with EB3 job requirement. I can get a promotion but that doesnt qualify for EB2 job requirement. So I am planning to move to a different position, Research Associate which qualifies for EB2(it requires masters degree) with the same employer. Can I file EB2 with this position and port my EB3-I140 PD? Advice pls.

I know that PERM labor gets expired if one does not file I-140 within 180 days of labor's approval date.
I am wondering if DOL has any procedure to revive expired approved/unused PERM by filing some sort of request/appeal or by paying some sort of fees etc. or if not ,then one files a new PERM by referring the old unused approved labor for the same job and same person then DOL can give an expedited approval.
They give 180 days to file...what stops the person from filing for the I-140 within the 180 day window in the first place? Are you talking about labor substitution? If so, they got rid of it because of extensive abuses and so, don't count on it.

Hello,
My friend has H1 and working for company A. He transferred his H1 and started working for company B (Its been 4 weeks and he has 2 paystubs from company B).
He is sure that company A didn't revoked / cancelled his H1. Now he wants to move to company A (old one). Is this possible?
or does he need to re-transfer his H1 from copnay B to company A?

Two questions for the experts...
I am on J1 visa and have received a home residency requirement waiver. Do the experts here know if I can apply for a J1 visa extension (after receiving the waiver)? I read somewhere that it may not be possible to do so.
Also, are there are any foreign travel restriction on a J-1 visa?

Getting a waiver implies that you want to change your status. So renewal may not be a good idea. I would talk to a lawyer about the implications.

I was under the assumption that you cannot file for EAD unless your I-485 application has been filed. How come Amit1234 applied for his EAD, his priority date is Jan 04 EB3. Just curious.

The person being sponsored does not need to sign the I-864A as a household member, unless you have family immigrating with you. The whole reason for using an 864A is to show that a "household member" agrees to be a joint sponsor. By definition, a household member must live in the same house, i.e. have the same address.
Provide whatever documents you have to show that you have the same address, but considering having a lawyer help you, since this is a bit of a mess.

no labor is position dependent not person dependent. You cannot make it go faster based on earlier 140.

If your company is regularly advertising and they have all the ad's in place as required by PERM , they can file your PERM and you can get your labor approval. If in case your labor is approved before 30th july you would be able to file concurrent 140 & 485 and can retain your PD too.
