    Thanks god_bless_you for you response. So it appears that I either have to have a valid H1 or EAD on hand in order to work.

    If you are extending the H1B, however, there is a grace period of 200 some day where you can work without a valid H1B while the H1B extension is pending. Isn't there a grace period if you are changing from H1B to EAD? From what you are saying, there isn't.

    They took her original 797 approval notice away....it did confuse her and also me.

    She just got her stamped passport back in courier yesterday, but there was no 797 with it.

    Should we contact the consulate for it?

    HI,
    I recently went for stamping in Canada and they did ask me recent paystubs.
    I woudl work for the new company , have some paystubs and then go to neighboring country to get the stamping done. But if the current visa on passport is valid for some more time, I dont think its really needed to get visa from latest company. To my knowledge u can always use old stamp to travel, as long as you have the latest aproval petition and you carry with you,I may be wrong if somehting changed recently,

    I dont want to go to my home country for stamping. I'm residing in california so i want to go nearby country which is Tijauna, Mexico.
    currently, my pay stubbs are still generated with old company (X). Now i've got I-797 approved from New company on June 6th,2006. Is it a must that i have to have at least couple of pay stubbs generated with new company before going for visa stamping

    You can file for your EAD and AP concurrently while you file for your I-485.

    EAD and AP are optional and don't necessarily need to be filed along with 485, and can be filed anytime as long as your I-485 has been filed , or is being filed.

    We have come here through legal immigration channels and we hope that our GC's or H1b gets cleared soon.

    Most of us would have stayed back if the Mandal comission / V.P. Singh wouldn't have spoiled our lives.

    Hello Immi Gurus,
    Our Division is in very bad situation and we are expecting some lay off's in next few weeks. I am working on h1b now but my 485 is pending for more than 180 days and have Valid EAD which I didn't use so far. following are my question:

    1) If I get laid off and my employer cancels the h1b, Am i out of status?

    2) Can they cancel my approved i 140?

    3) I am planning to use EAD for my next job, How much time do I have to find a new job to be in Status?

    I was in the same boat in 2009. I got laid off in Feb without a job for 4 months and found a job in June. Had no problems from USCIS, no RFEs. My H1 was revoked. My employer said that they won't revoke 140 and is not required for them to do so. I used my EAD in my new job. And one fine day in Sept got my GC. It was a roller coaster ride that ended well. I hope and wish you get a job soon and GC soon too.

    In my opinion, you are OK. My understanding is that the rule says that you need to have a job at the time of adjudication of your GC.

    BTW, I got labor approved on 3/1/2010, 140 on 3/25 and 485 approved on 5/5.

    A slightly off topic - but how did you know that your 485 was approved ?

    Can you tell us in detail how you got this information about your case ? I want to know if mine is approved or not.

    OR do some pro-bono sites for people who will reach a lot of people (and help out some needful people at the same time)...

    such as churchs, community groups, that kind of thing... then place a subtle ad on each of these sites, and then of course on your portfolio...

    They never need know how old you are...

    I certainly don't tell them I'm 40... :P

    Why are you trusting your lawyer if they cannot even remember where the A# came from? Makes me wonder how they justify their existence if this the level of their competence. If I was that bad at my job I would have been on a plane out of the US within a week or arriving.

    She's a good lawyer and I trust her and she has made a lot of successful H's, I140, Labor and GC cases. Very honest as well. So far in my case, we never had any problems and everything went smooth particularly when we were filing my PERM (which was very new during that time), she was really very cautious about it.

    Regarding the A# which I pointed out to her, I actually confused her with my question. With the number of cases she's preparing right now, I think she just forgot where you could find the A#.

    Are you kidding (about the refund)?

    true.. uscis never refunds.. except for H1B lottery cases...

    I got my GC approved couple of weeks ago.

    Even if you withdraw your application.. its gone.. think of it as a thankyou gift to USCIS... congrats on ur GC...

    Fun aside.. call them and find out if they can make any exceptions... And let the forum know if any positive news...

    You can also go to your local immigration office and talk to an IO in person and show him all the proofs and press release from USCIS website.

    They will be able to pull up your case and update the system with the details and make it as acceptable.

    To find out the nearest infopass office and schedule an appointment, use the below link

    As suggested by others it is better to seek advice of an attorney. But the above will help you to get through initially without any further delays and tension.
