Why do you think anyone in India including the government will spend there political good will to help people like us? Since we are planning to leave India for good and possibly become USC in due course of time there is nothing to gain from helping people like us. . They might ask for H1/L1 etc because it impacts Indian companies.

Hi there
I am currently working on F1-OPT with company A. Company A filed for my
H1B visa and it got approved, which is yet to start from Oct 2010. But now I
got an offer from Company B. I have to get my H1 transferred to company B.
I have informed my current employer(Company A) about this transfer.
But actually they(company A) are planning to withdraw my H1B visa petition
from USCIS as I will not be working with them from Oct 2010.
I would like to know if this will affect my visa transfer.
Can someone please let me know how it works and suggest me what should I do
to get my transfer done?

You can transfer your H1B before Oct. There is an option in the H1 application for that. I don't remember the exact wording, but one of my friend did this last year and it was approved.

Hi,
I need suggestion on travel.
I have applied AP for my wife on April 16 and still waiting. We have expiated her AP last week, still no updates. She has an emergency travel on June 20th. Her previous AP is valid till June 24th.
Can she travel out side on June 20th and come back with new AP when approved (I can mail her the new one once approved) or dose she needs to be in US until the new AP is approved?
As the old AP is valid till June 24th, dost it mean that they will approve the new one only after June 24th?
As this is an emergency I need your suggestion please...

One of my relative is on F1 visa, he wants to marry someone in India. He has applied family based GC. Can he bring that person in India thru a visitor visa here to USA and get married here ?
1. Is marriage between two non-immigrants valid in USA ? Can this marriage be registered here ?
2. Will his greencard process be in jeopardy if he gets married during the AOS wait time ?

He can marry in USA..it is not dependent on any visa.. Just check state residency rules..
Her visitor visa depends on her situation and interview.

She can stay as long as she wants, but it is finally up to the port of entry officer to decide to let her in or not depending on reason for staying outside (while 485 is pending) is valid or not. After all AP is supposed to be used only for emergency situations.
Can wife stay in India for more than 6 months while 485 is pending?
What she have now is an approved AP till 2009 december.

So what if DOL doesn't respond before the H1 expires..Can the Employer file for H1 Extension without an approved LCA ??
And if the LCA is denied because the DOL doesn't recognize the FEIN what options have we got..Can the employer reapply for LCA or just submit the Info and wait for info from DOL ??

I have e-filed my EAD & AP Renewal last week and trying to send supporting documents and I can't find what needs to be sent for this.....
Questions:
1) Do we need to send any photographs for my AP?
2) Any proof of Identification (passport first page) or Drivers License
3) Any H1 approval notices? (I am still on H1B)
4) Also I filed my AP which is expiring in Dec-08 i.e. 150 days before its expiry and curious to know if anyone�s application got rejected or approved. (I guess 120 days is the limit)
I appreciate your time and response.

Hi! I'm H1B holder and my company is willing to sponsor the green card. I'm coming from Eastern Europe (Moldova) and in US am working as software developer, I guess it's EB-3, right? The fingerprinting is generally scheduled to give enough time to the personnel at the center to do their job comfortably and not have a large waiting line. From my experience I found that the scheduling is loose and so the folks at the centers can accomodate an extra person very easily. Also these are contractors who get paid by the number of cases so they are okay with doing a fingerprinting if you turn up on an unscheduled day.
The best bet is to turn up on a weekday. I did this for both myself and my wife as we were headed to India the day our fingerprinting was scheduled. There was no one in line and the whole process took at most 10 minutes.

I have a question. Our files are stuck in the Chicago local office (after our interview last year) and the only thing pending is the Namecheck, which has been pending for more than 180 days. Our PD is current. Is anyone in the same position?
It is frustrating because you do not get any LUDs when your files are in the local office and I have no indication whether the Chicago officeis processing cases with NC pending > 180 days. Anyone knows?
